Proposed Standards for Privacy and Individually Identifiable Health
Information
X. Executive Order 13086: Consultation and Coordination with Indian
Tribal Governments
In drafting the proposed rule, the Department consulted with representatives
of the National Congress of American Indians and the National Indian
Health Board, as well as with a representative of the self-governance
Tribes. During the consultation, we discussed issues regarding the
application of Title II of HIPAA to the Tribes, and potential variations
based on the relationship of each Tribe with the IHS for the purpose
of providing health services. Participants raised questions about
the status of Tribal laws regarding the privacy of health information.
